Isn't content like this considered legacy and grandfathered in?
The ToS was changed a while ago to say that there "isn't any grandfather clause" anymore, but just that there isn't any push to delete the really old stuff... so basically, if someone wants to go flagging old stuff, it's still fine if they do, but there's no real reason to do so.
