While fair, I don't agree that concluding that Yoimiya is definitely about to rape a sleeping Klee is at all reasonable.

This is a bad debate do start, mostly because it's quite possible different legislations around the globe will have different definitions. For now, I'll post here a quick definition taken from the internets.
So, in my understanding, no rape has happened in this picture, as from what can be seen, Yoimiya didn't lay a finger on Klee. It is, still, quite possibly another kind of crime of obscene behavior to masturbate in public, in this case, next to a child.
Also, I once found a discussion on "masturbating while thinking of someone is the same as raping that someone" and that was just crazy.
