This is Sonozaki Shion, how? I found this same picture at Wakku Wakku in 2009. Right here and the one at pixiv says uploaded 03.31.2011 so doesn't this make an art-theft?

Not necessarily; sometimes artists upload the same piece of art at different times in different places.
It is in this case, though; the blog the Pixiv artist links is a spam blog. Removed the artist tag.
Well, I think it is most likely, an art theft. If the real artist uploaded it somewhere else and then uploaded it again on pixiv, surely he/she will add the correct tag for it.
